Modern Family star Sofia Vergara sued by her own embryos

Modern Family actress Sofia Vergara is being sued by her own embryos in a potentially landmark lawsuit.

Vergara, 44, split up with fiancé Nick Loeb, 41, in 2014, with the businessman at the time blaming Vergara’s career.

But since the split, Loeb and the actress have been engaged in a bitter battle over the embryos they created when they went through IVF treatment in 2013, with Loeb insisting he wants to raise them – without her.

He has already sued the star for custody of the embryos, but this new lawsuit could potentially set a precedent in the the conservative state of Louisiana.

A “right-to-live” suit has been filed on behalf of two of the embryos, referred to as Emma and Isabella.

The New York Post’s Page Six reported the suit centred on the argument they are being deprived of an inheritance from a trust set up for them by not being fertilised.

Vergara and Loeb signed a contract when they were together, stipulating neither one of them could use the embryos without the other’s consent, although Loeb now reportedly has argued the contract was never legal under Louisiana law, and should be voided.

After splitting with Loeb, Vergara married True Blood actor Joe Manganiello in late 2015.

She has a son with her first husband, who she married at age 18 and divorced in 1993.
