Academy sues over fake Oscars gift bags

The Academy of Motion Picture Arts and Sciences has filed a lawsuit against a marketing company for falsely representing their Oscar Nominee Gift Bags as officially affiliated with the prestigious awards.

For the last several years, the Los Angeles-based Distinctive Assets – also known as Lash Fary – has created gift bags for celebrity attendees as a promotion.

This year, the gift bags received widespread media coverage after they were marketed with slogans such as ‘Everyone wins at the Oscars!’.

The Academy has in the past attempted to prevent Distinctive Assets from using its brand to market their products, but it appears not to have worked.

“Last year, the Academy attempted to address Distinctive Assets’ false and infringing representation without litigation. We had no choice but to file a lawsuit,” an Academy spokesperson said on Friday.

On Tuesday, the Academy filed in the California federal court seeking an injunction and trebled profits and damages.

“Distinctive Assets’ continued use of the Academy’s trademarks not only infringes the Academy’s trademarks, but it is also likely to dilute the distinctiveness of the Academy’s famous trademarks and tarnish their goodwill,” the filing stated.

The filing took particular issue with the promotion of the “less-than-wholesome” inclusions in the gift bag, including a sex toy, a plastic surgery gift card and a marijuana vaporiser.

The Academy discontinued the distribution of gift bags in 2006 when the IRS demanded it pay taxes on all gift bags.
